Terms and Conditions

These following terms and conditions apply to individuals who are accessing or using the Program both as a merchant (“we” or “merchant”) and an affiliate (“you” or “affiliate”) who refers customers to use product or service from the merchant.

By participating in the Program, Affiliate agrees to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety you are not authorized to register as an Affiliate or participate in the Program in any manner.

The terms of this agreement are subject to change without prior notice.

1. Applying for our Program

a) HALCYON GIN reserves the right to decline or remove enrollment from our program at our discretion. You will have no legal recourse against us for the rejection of your Affiliate & Influencer Program registration.

b) As part of the signup process, you will be required to create an account with HALCYON GIN (‘Account’). By creating an Account, you agree to comply with our Terms (refer to section ‘Account’) and we agree to adhere to our Privacy Policy.

c) As part of HALCYON GIN’s Affiliate and Influencer Program and other review or feedback programs you may be permitted to create, upload, publicise, post or otherwise submit content (SUBMIT), such as reviews, comments, pictures and videos on your personal or business account (USER CONTENT). You must Submit User Content in accordance with the Terms (refer to section ‘User Content’).

d) As soon as your application is accepted, you can start sharing your affiliate link and earning affiliate payout.

2. Tracking your sales

a) Your affiliate dashboard is unique to you. It contains everything you'll need to promote our site and our product, including:

i) your affiliate link;

ii) one-click sharing to social media;

iii) banner ads;

iv) and more sharing resources.

b) You can also access your affiliate dashboard by downloading the Affiliate Dashboard via the LeadDyno app to your iPhone or Android smartphone.

c) As you send traffic to our website via your affiliate link, you will receive credit for each sale made through your link. Your progress for each category of referral will be reflected in real-time on your affiliate dashboard.

d) Each link provided by Sample has an Affiliate ID attached. We can't track your sales and traffic without you posting the full URL, so please be sure to use your affiliate link. Our social sharing shortcuts have your affiliate link embedded in their posts.

e) When a prospect visits our site from your affiliate link, we will be able to register their purchase (if/when they make one), and credit the sale to you.

f) As your referrals generate sales, you will earn affiliate payout. Please contact our affiliate manager for the most up-to-date payout percentages at partnerships@halcyongin.com.au.

3. Receiving your payout

a) ‘Commissions’, ‘payout’ and ‘payment’ refer to the event in which a customer makes a purchase on our website and you receive monetary benefits which are calculated based on Commission structure. So , as your referrals generate sales, you will earn an affiliate payout. Commission amount is dependent on the percentage of sale you’re assigned to and order value. Please contact our affiliate manager for the most up-to-date payout percentages at partnerships@halcyongin.com.au.

b) For an Affiliate to receive a commission, you need to specify your payment details on Settings. Payment schedule will be notified on Affiliate Guide page.

c) Payments will only be sent for transactions that have been successfully completed. Use of the Affiliate & Influencer Program is subject to a fair use policy which gives merchant the right to review each and every referral order. Status of commission if displayed in Commission tab, any paid commission will be listed on Payment tab. Transactions that result in charge backs or refunds will not be paid out.

d) Commission checks are issued on the 30th of every month. This is to make sure that the customer doesn't return the product during our money-back period. We pay you via PayPal or bank transfer. 

3. Creating content

a) As part of HALCYON GIN’s Affiliate and Influencer Program and other review or feedback programs you may be permitted to create, upload, publicise, post or otherwise submit content (SUBMIT), such as reviews, comments, pictures and videos on your personal or business account (USER CONTENT). You must Submit User Content in accordance with the Terms.

b) We ask you to limit your discussions to topics which are relevant to The Website and Purchase Products or services offered by HALCYON GIN.

c) Your content must be in accordance with the AANA Code of Ethics, AANA Food & Beverages Advertising Code and Australia’s Responsible Alcohol Marketing Code.

d) You agree that you are solely responsible for all User Content that you make available on or through our Site. You represent and warrant that:

i) you are either the sole and exclusive owner of all User Content or you have all rights, licences, consents and releases that are necessary to grant to us the rights in such User Content (as contemplated by these Terms);

ii) neither the User Content nor the posting, uploading, publication, submission or transmission of the User Content or our use of the User Content on, through or by means of the Website will infringe, misappropriate or violate a third party’s intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

iii) HALCYON GIN is not responsible, and assumes no liability for the conduct of any user of our Website or social media accounts. You agree and acknowledge that you participate on the Website or on our social media accounts by submitting User Content at your own risk.

e) Unless otherwise expressed in these Terms, to the extent permitted by law, HALCYON GIN will have no liability, and you release and discharge us from all liability arising from the posting, circulation or sharing of User Content developed by you including;

i) loss of, or damage to, the Products, or any injury or loss to any person;

ii) failure or delay in providing the Products;

iii) breach of the Terms or any law, where caused or contributed to by any event or circumstance beyond our reasonable control, act or omission of you or your related parties; or

iv) error, omission, interruption, lack of functionality or suitability (or the absence of, or reduction in, any anticipated result, outcome or benefit), delay in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records with respect to the use of Website, Products or any other products or services.

 

4. Cookie

  1. We use a cookie to track people who have clicked on your link, so they need to be using cookies for us to track them.

  2. If a person doesn't allow cookies or clears their cookies then we can't track them so can't pay earnings on that person's activity.

  3. Cookies day is said on the Affiliate registration form. The tracking day will start from the time a customer clicks on the affiliate’s link or use the coupon. Within the cookie time, every order made by this customer at merchant website will automatically result in commissions to the affiliate (There’s no need for the customer to click on the affiliate link then).

  4. We collect information in accordance with our Privacy Policy.

 

5. Sharing your content 

a) By making your User Content available on or though our Website or social media accounts, you grant to us an irrevocable, perpetual and non-exclusive, transferrable, royalty-free license to use the User Content with the right to modify, distribute, transfer, communicate, publicly display, transmit, stream broadcast or otherwise exploit such User Content on, through or by means of our Website, email marketing campaigns, public relations efforts and social media content.

b) If you provide us with photographs or videos of the products on or through our Website, via email, via your social media account or by tagging us on a social media network, you grant to us irrevocable, perpetual and non-exclusive, transferrable, royalty-free license to use the photographs, videos and/or details.

c) You also grant us the right to modify, distribute, transfer, communicate, publicly display, transmit, stream broadcast for the purposes of creating content for the Website, email marketing campaigns, public relations efforts and social media content.

5. Restrictions

a) HALCYON GIN reserves the right to remove any posts, reviews or comments (‘User Content’) on our Website or social media accounts which, in our sole discretion, are deemed to be in breach of these Terms, the AANA Code of Ethics, AANA Food & Beverages Advertising Code and Australia’s Responsible Alcohol Marketing Code and/or is deemed to be inappropriate. This includes:

i) portrays a minor (individuals under the age 18);

ii) may appeal to a minor (individuals under the age 18);

iii) promotes irresponsible, excessive or bing drinking of alcohol; 

iv) portray the consumption of alcohol before or during an activity that requires a high high degree of alertness or physical coordination e.g. operating a motor vehicle, boat, machinery or swimming;

v) makes false, misleading or deceptive claims about the product, including health, therapeutic or environmental benefits

vi) defame, harass, threaten, stalk, menace, track, monitor, hurt, mistreat, offend or otherwise hurt any person;

vii) promotes violence or uses derogatory, discriminatory or offensive language including towards another person or competing brand names

viii) include link(s) to inappropriate, offensive or illegal material on the forum; or

ix) could be considered intolerant of a person’s race, culture, appearance, gender, sexual preference, religion or age.

6. Disclosures

The Australian Competition and Consumer Commission (ACCC) has endorsement rules in place for affiliate marketing. In short, they want you to disclose that you have a business relationship with us when you promote and post your link. You can read the full rules about disclosing commercial relationships here.

When posting or sharing your link, you should make it known to your readers and followers that you will receive compensation if they buy a product via your link. This declaration should be clear and conspicuous (and reiterated as needed). An example of disclosing this in your social posts is by using #ad, #paidpartnership #paidpromotion.

7. Terminations

HALCYON GIN can end this relationship and your association with our program(s) at anytime. If an affiliate wishes to be removed from the affiliate program, they can do so by contacting partnerships@halcyongin.com.au.

3. How we collect your personal information

We may collect information from you whenever you:

a. access or interact with our website, online store, or social media page;
b. order and purchase products from us;
c. create or login to your account;
d. use, click or follow a link provided by one of our 'affiliates'; 
d. consent to receive marketing materials; or
e. contact us for any other reason.

We also collect cookies from your computer, which are data files placed on your device that often include an anonymous unique identifier, and similar technologies when you use the website.
